Terms of Service

1. Who this agreement is with

EZQizy ("the Service") is operated by ERDSYSTEMS LLC (Enterprise Resource Development Systems), a limited liability company with a principal place of business at [COMPANY MAILING ADDRESS] ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Service.

2. Who may use this Service

EZQizy is open to anyone who wants to practice quizzes and self-assess their knowledge ("Users," "you"). No invitation or approval is required to create an account - just an email address.

You must be at least 13 years old to use this Service. We ask for your date of birth when you sign up to confirm this. EZQizy does not knowingly allow anyone under 13 to create an account, and does not knowingly collect personal information from anyone under 13. If you are under 13, do not use this Service - a parent or guardian may contact us (see Section 13) about other options.

3. What the Service does

EZQizy lets Users sign in with Google or a one-time code sent to their email, build their own private question sets, and take practice quizzes to test their own knowledge. Users may write questions by hand or import them from files they upload, and may upload documents to search. Everything a User creates or uploads is private to that User's account.

4. Your account and access

• You are responsible for keeping access to your email account secure, since sign-in relies on it.
• You agree to provide accurate information (your email and date of birth) when using the Service.
• You may not share your access, attempt to access another User's account, or attempt to access the Service if you do not meet the age requirement in Section 2.
• We may suspend or terminate your access at any time, including if we reasonably believe you've violated these Terms.

5. Acceptable use

You agree not to:

• Copy, distribute, or share quiz questions, answers, or content outside the Service;
• Attempt to bypass authentication, access controls, or otherwise circumvent the Service's security;
• Use the Service to submit false information, or attempt to interfere with its normal operation;
• Use the Service for any purpose other than personal practice and self-assessment.

6. Quiz content and results

The Service itself - the software, its design, and any questions the Company supplies - remains the property of the Company. Questions, sets, files, and documents that you create or upload are your content, and Section 7 governs them. Your quiz responses and scores are recorded and visible to you. See the Privacy Policy for more on how this data is stored and who can access it. EZQizy is a practice and self-assessment tool - your results are not a certification, credential, or guarantee of performance on any actual exam, job application, or other real-world assessment.

7. Content you upload is your responsibility

"Your Content" means anything you put into the Service: questions and answer sets you write or import, files you upload (including PDFs, spreadsheets, and text or Markdown documents), and the text extracted from them.

You keep ownership of Your Content. The Company claims no ownership of it. You grant us only the limited permission needed to store, process, and show it back to you so the Service can work - for example, reading a PDF into questions, or indexing a document so you can search it. That permission ends when you delete the content or your account.

You are solely responsible for Your Content. By uploading or creating it, you represent and warrant that:

• you own it, or you have the rights and permissions needed to upload it and to use it this way;
• it does not infringe anyone's copyright, trademark, trade secret, privacy, or other rights;
• uploading and using it does not breach any licence, subscription agreement, terms of sale, exam confidentiality rule, or non-disclosure obligation you are under;
• it is not unlawful and does not contain malware;
• it does not contain other people's personal, medical, financial, or otherwise sensitive information without their consent.

Copyrighted study guides, exam banks, and published question sets are the case worth naming outright: whether you may upload one depends on the licence you bought it under, and checking that is yours to do, not ours.

We do not review Your Content. The Service stores and processes what you give it automatically. We do not check it for accuracy, legality, or whether you had the right to upload it, and we take no responsibility for it. Nothing you upload is endorsed or verified by us, and an answer imported from a file is only ever as correct as that file was.

We may remove content or suspend an account if we receive a credible infringement complaint or become aware of a breach of these Terms, though we have no obligation to monitor for either.

You will indemnify the Company. To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ERDSYSTEMS LLC and its officers, members, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of Your Content or your breach of this Section.

Keep your own copies of anything that matters. EZQizy is not a backup service, and deleting a set or an account deletes its content.

8. Beta status; no warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," IN BETA, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee the Service will be uninterrupted, timely, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, ERDSYSTEMS LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. No professional or employment relationship

These Terms govern your use of the Service itself and create no employment, contractor, educational enrollment, or professional relationship between you and the Company. If you separately have such a relationship with the Company (for example, as an employee using EZQizy for work-related practice), these Terms do not replace or modify any separate agreement covering that relationship.

11. Changes to these Terms

We may update these Terms as the Service develops out of beta. We'll update the "Last updated" date above; continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles, unless applicable law in your jurisdiction requires otherwise. [Confirm this matches ERDSYSTEMS LLC's actual state of formation/principal place of business before publishing.]
